GENERAL
All quotations and invoices from Orior® are valid and binding for 30 days. Orders are activated with a 50% non-refundable deposit, except for stock orders which are confirmed with a non-refundable 100% payment. The final balance and shipping fees must be paid before delivery can be scheduled. Orior accepts payment by wire transfer, check, or credit card. Please note the invoice number on wire transfer or check payments.
Sales tax is collected on all orders shipped to a New York State address, unless a resale certificate is provided. Residents in other states are responsible for complying with local state tax laws
Rush orders require pre-approval and may incur a 25% fee. Rushed orders are to be paid in full before production can begin.
MATERIALS
Orior’s natural materials such as stone, leather, metal, and wood have unique characteristics and may therefore vary from what is represented on our website or in our photography. Orior cannot guarantee an exact finish match of samples due to the inherent characteristics of natural materials. Orior is not responsible for damages or change in appearance in our products once delivered.
COM or COL materials must be approved prior to ordering. Orior does not warranty COM or COL materials.
LEAD TIME
Production lead time provided on quotes and invoices for our made-to-order pieces are estimates based on average turnaround time. Orior makes no guarantee of delivery date. Production lead time begins upon receipt of the deposit and confirmation on all order details.
Force majeure: all quoted completion and delivery dates are estimates only. Orior and our shipping partner are not liable for delays in completion or shipment or default in delivery for any reason of force majeure or for any cause beyond reasonable control including, but not limited to, (a) government action, war, riots, civil commotion, embargoes or martial laws, (b) manufacturer's inability to obtain necessary materials from its usual sources of supply, (c) shortage of labor, raw material, production or transportation facilities or other delays in transit, (d) labor difficulty involving employees of manufacturer or others, (e) fire, flood or other casualty, or (f) other contingencies of manufacture or shipment. In the event of any delay in manufacturer's performance due in whole or in part to any cause beyond manufacturer's reasonable control, manufacturer shall have such additional time for performance as may be reasonably necessary under the circumstances. Acceptance by buyer of any goods shall constitute a waiver by buyer of any claim for damages on account of any delay in delivery of such goods.
SHIPPING / DELIVERY
For all sales, the cost of shipping and installation is not included in the product price. All shipping charges are proforma and will be included on the final balance invoice. Quoted shipping before the balance invoice is not guaranteed and is subject to change. Orior is not responsible for uncrating, debris removal, installation, final placement, and leveling. Orior highly recommends using a qualified receiving warehouse to receive, uncrate, inspect and facilitate in-home deliveries. If needed, Orior can recommend a receiver or white glove delivery service.
All damage claims must be made in writing to info@oriorfurniture.com within 48 hours of the receipt of goods. Damage claims must include photographs of the crate upon its arrival and detail shots of the piece. If damage has occurred in shipping, all packaging must be retained by the receiver; failure to do so may invalidate any claim.
If the customer chooses to manage their own freight and delivery, Orior will provide crate dimensions, weight, pick up address and window for collection. Ownership of the product transfers to the customer (owner) upon the freight carrier taking possession of the order for transport. Therefore, responsibility for damage occurring in-transit is the owner’s and all claims for freight damage must be made within 48 hours of receipt.
WARRANTY
Our products are guaranteed for one year against any mechanical defects or technical failures. Should an issue arise with your product, please inform us and we will work with you to resolve the issue quickly. Orior cannot be held responsible for the following: changes to the surface of unsealed metals, damage caused by improper care, damage caused by the use of improper cleaning solutions, damage caused by exposure to weather or improper environmental conditions, damage caused by improper assembly or installation, damage caused by typical wear and tear including but not limited to scratches, dents, or stains. Inherent features in natural materials will not be misconstrued as damages.
ASSUMPTION OF RISK
Oriors products are heavy and should be lifted properly by professionals. Customers understand and voluntarily assume the risk of personal injury sustained while moving the products. Additionally, customers agree to indemnify, defend, or hold Orior harmless from any third-party claims arising from such use.
Deviations from these general terms and conditions of sale and delivery shall be permitted only by written agreement between the buyer and Orior.
